Terms & conditions

Overview 
This website (bicyclegarage.co.za) is operated by Bicycle Garage (a Cycle Solo Distributors (Pty) Ltd (2019/037278/07) devision). Throughout the site, the terms “we”, “us” and “our” refer to Bicycle Garage. Bicycle Garage offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here and the general terms, conditions, policies and notices of the bicyclegarage.co.za website. 

Information on the website 
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

Indemnity 
You agree to indemnify, defend and hold harmless Bicycle Garage and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

About BGAP
Our main goal is to help you reach your full potential and be the best you can be. The BGAP program is actively supporting athletes and growing professional endurance sports in South Africa by narrowing the GAP between athletes and sponsors. We offer endurance athletes an opportunity to list their profiles and results on the BGAP platform. All endurance sports, levels and ages are welcome.  While we will attempt to list any athlete, we can refuse any BGAP application or remove any athlete profile without notice from the bicyclegarage.co.za website. We do not have to accept applications and do not have to justify our reasons. We can at any stage remove, amend or edit information on any person's profile without notice. 

Benefits of joining BGAP  
In addition to be listed on the BGAP online platform, athletes receive 20% off BG race transport and servicing packages and a minimum of 10% off products on the bicyclegarage.co.za online store. Bicycle Garage reserves the right to amend these conditions at any stage without notice. 

How to sponsor 
Anyone can contribute towards an athlete's career and help grow the sport. From race specific, full sponsorships or general support, click on any athlete's profile and follow the instructions. Bicycle Garage reserves the right to amend these conditions at any stage without notice. 

How to join as an athlete 
Bicycle Garage levies a R500 annual (365 days) administration fee (that starts from when the annual fee reflects in the relevant Bicycle Garage bank account as required) to maintain annual online listings and a 10% sponsorship fee. The sponsorship fee is 10% of total funds received per your profile. This ensures that athletes only pay a 10% fee for funds received while incentivising the BGAP team to actively find sponsorships for athletes. Bicycle Garage reserves the right to amend these conditions at any stage without notice. 

BGAP Star ratings
The BGAP team rates athletes using an internal framework that is based on an athlete's overall marketability. The rating is based on current form, past results, prospects, personality, social media following, professionalism and general marketability. Bicycle Garage reserves the right to amend these conditions at any stage without notice. 

You may terminate these Terms of Service and request that we remove your profile from the website at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

We reserves the right to change these terms and conditions at any time without prior notice.
